Congratulations

We are happy to say that, from a preliminary screening, you have at least one case in your Oregon records which eligible to set aside.  Please read the information below carefully and let us know if you have any questions at roe@qiu-qiulaw.com

ANALYSIS

We are only able to access your public Oregon records. Your analysis may be different if you have had cases which were

  1. previously expunged

  2. from States besides Oregon within the last ten years

  3. from Federal Court within the last ten years

  4. from local District Courts, e.g. Medford Municipal Court from within the last ten years

Please email us at roe@qiu-qiulaw.com if any of the above apply to you, and we will update your analysis.

Setting aside your records on your own

You do not need a lawyer to set aside your records. Your records are available at the courts in which your cases occurred, and you can find instructions to expunge your records at that court's website. The Jackson County Court website is listed below. Forms and instructions are listed under 'Criminal Forms' -> 'Set Aside.'

https://www.courts.oregon.gov/courts/jackson/help/Pages/Forms.aspx

Be advised that each county in which you have at least one conviction will charge $80 plus an additional $281 per conviction. The $281 is subject to an income-based waiver.

Setting aside with Community Clinics

We understand that the procedures listed above are complicated, that court personnel are not allowed to assist you, and that lawyers for expungement typically cost thousands of dollars. That is why we are hosting Community-based clinics to help with the process. At these clinics, we will be going over in detail the filing procedures and answering any questions you have. You will also leave with a packet containing:

- Completed and notarized expungement paperwork for all your eligible Oregon cases

- Completed fingerprint cards

- Instructions for filing paperwork

Your Contribution

To offset the cost of these clinics, we are asking for a $50 contribution from everyone. You will be able to pay this at the clinic with credit/debit card or cash. Our goal is that no one will be turned away from our clinics for inability to pay. Please let me know if the $50 is beyond your means and we will find another way for you to contribute.

You will also be responsible for filing your own paperwork, including the fees mentioned above. We will be reviewing ways in which you can minimize your costs by obtaining fee waivers.
